Operator and marketplace role

[MARKETPLACE OPERATOR LEGAL NAME] operates GatorBid Auction Marketplace and is referred to as GatorBid, we, us, or our. Our legal-notice mailing address is [LEGAL NOTICE MAILING ADDRESS].

These terms are between you and the marketplace operator. GatorBid supplies auction technology and administers marketplace account, security, payment, and pooled-escrow functions. The auction company identified on an auction page conducts that auction. The company or identified seller is responsible for the items, descriptions, seller authority, auction terms, taxes, title, pickup, shipping, and fulfillment assigned to it. A GatorBid-affiliated auction company remains a separate auction participant unless expressly identified otherwise.

GatorBid's responsibility for its own marketplace and payment functions is not transferred to the auction company by these terms. The Bidder Terms and the separate payment permissions presented when you act describe how authorizations, escrow, and charges work.

Agreement and eligibility

You accept these terms when you affirmatively agree during account creation, an account terms acknowledgement, a company application, or staff invitation acceptance. You must have legal capacity to enter this agreement. A person acting for a company must be authorized for the role and commitments they undertake.

Provide accurate information, protect your credentials, and use only accounts and staff permissions you are authorized to use. Auction registration and approval are separate from marketplace account creation. A company may approve, reject, suspend, or revoke auction registration in accordance with published auction terms and law.

Applicable documents

The Bidder Terms apply when you bid or buy. The Seller and Auction Company Terms apply to your relevant seller, company, or staff activities. The Privacy Policy describes personal-information handling and does not by itself supply consent to identity verification, marketing, or payment.

A signed agreement with GatorBid controls over these general terms only for the parties and subjects it expressly covers. Specific payment or escrow permissions govern the authorized payment action. Auction and lot terms govern that auction's items, fees, taxes, reserves, and fulfillment; they do not expand GatorBid's payment permissions or give company staff access to other companies' bidder information. The applicable Bidder or Seller Terms control over these general terms on their specific subject. Mandatory law prevails over every document.

Acceptable use

  • Do not interfere with account security, bidding integrity, availability, or another user's use of the marketplace.
  • Do not submit false registrations, manipulate bids, evade controls, scrape abusively, upload unlawful content, or list prohibited items. Authorized marketplace bidding tools remain subject to their displayed limits and auction rules.
  • Use catalog content only with the rights granted by its owner or by law. Report alleged copyright infringement through the DMCA Policy.

Availability and sale decisions

Access depends on networks, devices, service providers, and auction operation; uninterrupted or error-free service is not guaranteed. A submitted command, a video image, or a local countdown is not confirmation of a winning bid. Check the recorded bid response and sale result.

Timed deadlines and extensions are determined by the marketplace's auction clock. Webcast sale decisions are recorded by authorized auction staff. Any correction, withdrawal, or reopening must follow applicable law and auction rules. Contact the auction company promptly about a disputed bid or sale, and marketplace support about account or service problems.

Changes and existing commitments

The version and effective date appear on each policy page. Changes are announced there with a description of the revision. A new version of contractual terms applies to you when you accept it; posting a change does not rewrite an already accepted bid, completed transaction, or recorded payment permission. Additional notice or consent required by law must be provided before the relevant change takes effect for you.

We record the accepted version, the text presented, the time, and the relevant account or application when you agree. This revision updates the marketplace trade name to GatorBid; marketplace responsibilities and the priority of documents remain unchanged.

Disputes, governing law, and contact

Texas law governs this marketplace agreement to the extent permitted by applicable law, subject to any controlling signed agreement with GatorBid. This choice does not remove mandatory consumer protections. Auction-specific dispute provisions apply to disputes with the company or seller for that auction and do not, by themselves, choose a forum or change this agreement for a dispute with GatorBid.

Contact support@clarkauctions.com about marketplace disputes or send legal notices to [MARKETPLACE OPERATOR LEGAL NAME], [LEGAL NOTICE MAILING ADDRESS]. Contact the company shown on the auction page about item, invoice, pickup, shipping, or seller disputes. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded.
