Parties and auction terms
[MARKETPLACE OPERATOR LEGAL NAME] operates GatorBid Auction Marketplace and is referred to as GatorBid, we, us, or our. Our legal-notice mailing address is [LEGAL NOTICE MAILING ADDRESS].
These terms supplement the Terms of Use for bidders. The company and seller identified with an auction are the auction participants; GatorBid administers marketplace functions. Read the auction and lot terms, fees, reserves, inspection information, and fulfillment requirements before registering or bidding. Listing-only catalogs do not accept bids.
Registration and approval
- Biddable auctions require registration and may require identity verification, a verified payment method, escrow sufficiency, tax documents, or manual approval. Approval for one auction does not approve you for another.
- The company running your auction receives the contact, registration, bidding, invoice, and fulfillment information needed for that auction. Escrow information shown to ordinary company staff is limited to that auction's requirement, reserved exposure, sufficiency, payment, and review signals. It does not include your global pool balance or other companies' funding and activity.
- Registration sufficiency is a check of available escrow, not a reservation of money for that auction. Later bidding commitments can change the amount available.
Bids, acceptance, and corrections
A bid is an offer to buy under the applicable auction terms. A max bid or prebid authorizes the system to submit bids up to the stated ceiling under those rules. You become responsible for the purchase when the sale is completed and your bid is accepted as the winning bid, subject to any disclosed reserve or seller-confirmation requirement and applicable law.
The bidding controls do not retract an accepted bid. Contact the auction company immediately to request a correction or a retraction permitted by applicable law or enforceable auction terms. The absence of a retract button does not waive a legal right. Canceling future automated bidding instructions does not itself undo bids already accepted or purchases already made.
Timed, webcast, and automated bidding
- Timed auctions close using the authoritative auction clock. A bid near closing can extend a lot and, where configured, other lots in its close group. The displayed close time can therefore change.
- Max bidding advances your bids under the increment and priority rules up to your ceiling; the ceiling is not a promise that you will win. Your bid amount does not include additional buyer premiums, taxes, shipping, or other posted charges.
- Webcast auctions combine online, prebid, and staff-entered floor bidding. A pending online submission requires the applicable acceptance step; video, network delay, review, and auction state can differ from the authoritative bid record.
- If you use marketplace strategy or budget tools, review their lot selections, limits, and displayed cost basis. Those instructions authorize the resulting bids. Canceling a strategy stops future activity as described by the tool and does not release existing winning or leading commitments.
Saved cards and optional invoice auto-pay
Saving a verified card does not by itself authorize every future charge. Payment actions require the applicable permission shown when you pay, authorize escrow, or opt into invoice auto-pay.
When you separately opt into auto-pay for an auction, you authorize the posted invoice to be charged using the eligible default saved card under the selection shown during registration. An unsuccessful attempt may be retried once after 24 hours, with a notification of the outcome. Manage cards and revoke that auction's auto-pay permission from your account before a charge begins. Revocation does not reverse a completed charge or cancel an amount you owe.
Reusable escrow and card holds
GatorBid manages one reusable USD escrow pool per bidder across eligible platform-operated companies and auctions. An authorization is a temporary card hold that may reduce available credit; it is not a cash deposit or completed payment. Captured cash and eligible holds are accounted for separately.
Accepted bids, wins, max or proxy instructions, and strategy commitments can reserve exposure against the pool, reducing what is available for other auctions or release. Meeting a registration requirement does not reserve that amount. An expired hold or disputed funding can reduce eligibility and require new funding or review.
Applying escrow to an invoice requires the separate current capture permission presented in the escrow flow and the applicable eligibility checks. Agreeing to these Bidder Terms alone does not authorize escrow capture. A hold without that permission can support bidding but cannot be applied to invoices. Review the amount and scope before authorizing or renewing a hold.
Release, refunds, and disputes
Request release of eligible unused holds or refund of eligible unallocated captured cash from your account. Existing reservations, allocations, pending operations, disputes, or review can restrict the amount or timing. Your card issuer determines when credit becomes available after a hold is released or expires.
Contact the auction company about a refund of an invoiced purchase; it may need to request marketplace review for a payment funded from pooled escrow. A refund request is not confirmation that a refund has completed. Payment disputes or reversed funding may restrict the pool and future bidding while any deficit is resolved. These processes do not remove rights you have under applicable law or with your payment provider.
Conduct and completed purchases
Do not shill bid, use undisclosed related accounts to manipulate prices, submit false information, evade bidding limits, or interfere with others. Seller or seller-agent bidding is permitted only when lawful and expressly disclosed and allowed in that auction's terms. External automation and scraping must not create an unfair advantage or disrupt an auction.
Winning bidders owe the accepted price plus the disclosed buyer premium, taxes, and other applicable charges. The buyer premium is paid to the auction company running the sale. The auction and lot terms determine condition statements, warranties or lawful as-is provisions, inspection, payment deadlines, pickup, shipping, storage, title, and transfer. These marketplace terms do not impose an undisclosed as-is sale or waive mandatory consumer rights.
This revision updates the marketplace trade name to GatorBid. Auction-company identity, buyer premiums, and payment permissions remain unchanged. Changes and the priority of documents follow the Terms of Use.
